My visa is about to expire and I am still not in Australia

Dear all,

I received my visa in 2002. I have made my first entry in 2002 but did
not manage to find a job. I am in IT industry and back in 2002, the
market was repressed. My visa will expire in July next year.

I would really like to go to Australia but I am in a dilema. I met my
girlfriend last year and we have been getting along really fine. We
plan to marry soon. However, we both feel that we do not have enough
money to go Australia just yet.

I'd hate to see my visa forfeited just like that. What can I do to
apply for an extension?

I have heard of RRV but I have not spent 2 years there.

Any advice would be highly appreciated.

are,  save some more money, see how  things go with your girlfriend.
I don't think there is much point in trying to protect your present
visa if you reckon that you would not be able to afford to live, earn
and pay tax in Australia, is there?  Presumably the tax-collector in
another country is currently benefiting from your expertise in IT and -
as a result - your income tax payments?

Why would you want to live in Australia when it seems that your
prospects - professional  and pe rsonal  - are much brighter elsewhere?
Governments have an uncanny if  inconvenient habit of imagining that
commitment to a country is demonstrated by your willingness to pay tax
on your contributions to that country's economy.

Don't think whether the available career paths for you in Oz were to
your liking (you could've always got a job outside of IT) followed by
the inconvenience of interrupting your new love life, followed by the
fact that you don't think you could afford to live in Australia as yet,
followed ny never having paid tax in Oz are likely to attract much
sympthy from DIMA.

I suggest you obtain the best professional advice you can find, to see
whether a clever (if expensive) lawyer can think of a way of turning
what you say into a demonstration of close ties with and commitment to
Australia, my friend.

Hi Gill,

Yes, I am paying tax in my home country. I don't mind paying taxes. If
I have a proper job in OZ, I would be more than happy to pay tax. As to
your question of why my girlfriend and I would like to stay in OZ, I
guess the reason is because Australia is such a beautiful country. And
the weather is so much more pleasant that the place I am currently
staying. Of course, OZ has a  lot of other opportunities, etc.

I guess time is against me. Dare I move to OZ alone, look for a job,
stay put for 2 years and marry later? I think I have save enough for
one person to live and stay in AU but not two.

I bet that if I have a 1 or 2 year extension, I am pretty confident
both of us will be able to make it there. My girlfriend is an
accountant.

Do you know if it is possible for me to apply as a spouse visa? ie.. my
own visa expired and my girlfriend or wife applied for a visa and I go
in as her spouse?

presumably she can work in Australia?

I think you ought to talk to a Registered Migration Agent urgently
(which I am not.)  From my (slight) reading about RRVs, you would only
be able to get one that would permit you to remain outside Oz for 3
months after the travel-validity of your current visa lapses, and even
that might be a very long shot when you have made no real effort to
move to Australia from what you are telling us.

It does not sound to me as if 15 months more outside Oz is likely to be
enough, hence I think you need to re-consider all your posible options
from scratch,  with the right professional help.

Sorry I can't be more use but I have no personal experience of your
dilemma.

Thanks for writing. Irregardless, I value your opinion.
My girlfriend is not Australians but she has ACCA so, I think she'll
just need to sit for a CPA exam to be able to qualify to work.
