Child Migration Form- 40CH Question 13 and 20.

Hi All,

We were granted the permananent residence(PR)visa in Jan 2002 and We
validated our PR visa in Feb 2002, we have not yet moved permanentaly
to australia i.e. we are outside Australia in the Gulf.

We now have a new born baby, born in march 2003. We have now is the
process of logging an application for the new born, I have a few
questions as I have started to fillout the form 40CH.

Question 13
Do you have sole legal rights to determine where the child shall live
or to remove the child from thier home country?

We (Myself and My Spouse)plan to give a Statuatory declaration that we
have no objection to the childs migration.

My question is Can we just type the letter and sign it or does it have
to be notarised by a Justice of peace eg. Notary.

Question 20.
Your Current residential address Note- if your residential address is
not in Australia, Please attach a statement outlining how you will
meet your sponsorship obligations (see part L)

Part L states as follows-
I agree-
-to provide information and advice to help the person I am sponsoring
settle in australia
-To ensure that adequate accommodation is available to them on arrival
in australia or, provide accommodation for up to 2 years from arrival
is australia, or the 2 years following the grant of your child's visa
if your child is applying  in australia
-to provide support as required to enable them to attend appropriate
English language courses.

We are living outside Australia, What document/statement I have to
give to prove the point??????.
I would be really greatful if someone can throw some light on this
please.

[Dear Tom,

Congratulations on your new born.

Question 13 relates to the Hague Convention and is not applicable in
your case - present your childs full birth certificate - showing you and
your spouses details as parents  and you will be fine on this count. (ie
- you have the right to take the child to Australia)

No need for a stat dec.

RE: question 20 - s short letter outlining how you intend to earn a
living in Australia will do the job for the other question.
