MODL Changes

Hi,
I will be applying for my visa in a couple of weeks when I get my new
passport back. I am applying under skilled independent subclass 136. I
have been assessed by the Australian Computer Society and have extra
points for being on MODL list.

I understand that the MODL list will be checked and updated in October
and I am worried that my nomniated occupation 2231-79 (Network
Security) will be removed because contacts I have in Aus say that IT
jobs are drying up a bit now.

What I want to know is at what stage will my application be valid if my
occupation did get removed from the MODL. If I apply and I get a
receipt of application is that good enough or does it need to go futher
or even complete? After all the work I have put in to this I would be
gutted if I din't make it.

Hi Rick,

As I understand it, if there are MODL points to your benefit either at
the time of application or at the time of processing (i.e. when a CO
starts looking at you application) then you get the MODL points.  So say
when your application is received by DIMA you occupation is on the MODL
then you get the extra points regardless of whether it then stays on the
list until you application is processed.

Thanks for the reply, that's good news. Do you know roughly how long it
takes for a CO to be assigned to the application once it has arrived at
their offices?

Hi Steve,

Quite correct, that was the position established by the Federal Court
case Aomatsu last year and in fact from 1 July this year it's in the
regulations.  But generally anyone with a skills assessment is able to
lodge an offshore General Skilled Migration visa application provided
they've also got the forms and the fee - no need to wait for a new
passport or any other document, that can all be put in later.  So
frankly I don't know what Rick's waiting for.

Hi George,
Thanks for the post. My wife and I have until May '08 on our passports
and our children until July '07. On the forms it says that you must
have two years left on your passport before applying. I haven't
actually sent them off yet for renewal, do you think it is best to get
the visa in progress and then renew our passports later?
