This is my first thread, and first visit to this site. I have taken
some time to read the threads that might relate to me, but nothing bang-
on to our situation, and we could really use some guidance or advise.
I am a Canadian Citizen, my boyfriend is American. We have been
together for almost 2 years, and would like to start our life together.
Being apart, doing the every-6-week-visit-thing was killing us...
finally he has come home. I was in contact with an immigration lawyer
before my boyfriend came up, and he advised me that we could not qualify
for 'conjugal partner' as there is no SOLID reason for us to not live
together (other than border control). So, currently, he is here as
'visitor' and we are building our way up to 'common law' ... it's been
almost 3 months since he got here, and we're really not sure how to
proceed. How do we go about getting an extention on his visit? Does it
matter that he is travelling with a birth certificate, not a passport?
How detrimental would it be to the immigration process if he were to
pick up an under-the-table job? Would it simply be easier/faster for
all involved for us to get married and file as spouse? Please... any
help or advise would be very much appreciated.
(sincerest apologies if this is a repetitous request... as I said, I was
unable to find all my answers in previous threads, and to be quite
honest... CIC confuses the life out of me.)

Understand if you are really in Canada that there currently is approx
400,000 undocumented workers in Canada. That CBSA can only remove 10
thousand a year.
I am not telling you to tell your partner to work without authorization
but understand that working without authorization does not make your
partner inadmissable to Canada.
I strongly suggest that you submit an application outside of Canada
because that is how CIC wants it and it is 10 times faster. See address
on Schedule 1 form.
Go to www.cic.gc.ca and look at whats new and go to February 18th 2005
and FAQ I believe Question # 10 which will show you the real processing
times. Plus information on the new program. Then go to www.cic.gc.ca

Hi there. My partner and I did the every TWO week visit thing - he
from Victoria, me from Portland, OR - and it was hell. So you've got
over that hurdle with your boyfriend moving to Canada to join you. My
advice would be to get married. My partner and I did - a year ago May
- and he sponsored me afterward as his spouse. By 15 February I was
able to land, and by 25 February I had moved up to Vancouver Island to
join him, lock stock and barrel. CIC can indeed be confusing - I won't
go into the whole story unless you really want to know - but I will
hand to them that they processed our paperwork with amazing speed.

I stongly advise that your boyfriend NOT take under-the-counter work as
becoming out of status as they say will not be appreciated by the CIC. As
always simple is best - marry and sponsor him within Canada. He would ahve
to wait some months before he could work but a wp would be issued once the
application for PR was approvied in principle. Alternatively - marry and he
goes back to the USA and you sponsor him. He can work in the USA and would
be immediately able to work once his visa is issued and he lands in Canada.
But, if he stays in Canada and you do not marry he had better not work as
that would jeopardize the whole thing.
