Withheld tax and forms

I worked for 3 months for a US company from Canada (from home). This
company withheld 38% for taxes. However, after the end of the 3 months
(when I resigned), they did not give me any official form declaring the
total income, withheld taxes, and net income.

-Should I get a 1099 or W2 (or something else)?
-What if the company does not give me a form? what should I do?
-Do I need to file in US too?

You should get a W2 in January of the year following the work.  So, if
you worked in 2006 you should get it in January 2007.

Call them up and ask for one.

If you want a refund of the withheld taxes, yes.  Otherwise, it probably
depends on how much you made and who knows what else, but only a tax
lawyer or the IRS could tell you for sure.
