Extreme delay in Spouse case

Hello Friends,

My wife applied for PR under the Live-in Caregiver in Canada 3 years
ago. I was in Canada at the time but i came to get processed in India.

The problem is that its 3 years now since we have applied and been
separated but CIC is still processing our applications. The file is now
in Vancouver CIC office but even now they are not giving us any
time-frame as to when they will finish processing. We have sent many
letters, also tried our MP but even he is unable to help. CIC just says
they are waiting for background checks. We are going through too much
hardship and pain.

Is there anything we can do?

Should we apply for a Mandamus Order?

Can i get a visitor visa to visit my wife?

Your advice will be appreciated.

Hire someone to find out what is going on with your backgroud checks.
Ascertain from CSIS directly and others if checks have even been
requested. Get the CAIP's and Foss notes then if necessary go after the
complete file. 3 years is excessive and on ocassion I have known them to
be complete but the results not placed on the file correctly. Background
checks are three fold, Security (CSIS) Convictions (Fingerprints) In
Canada information (Foss)  :D :D

Thanks a lot Mr Roy,

I will try to get CAIPS notes. The thing is, we don't have a lot of
money. We will try to get a Immigrant Society lawyer.

Should we also try to file a Mandamus petition? Is is a good idea? Cost
a lot of money?

We are really desparate to see each other. My wife is on single entry
work visa, so i dont want her to risk coming to India.

Dear Mr Roy,

Also how do I ascertain from CSIS directly? Can my wife just write to
them? At their Ottawa address?
