What are my chances?

Hello.     I don't have custody of son,Although he physicallyhe's been
with me since birth.His Dad shed a few years with us. I left under
indifference circumstance.I know a letter of consent is require from
his dad.which of cause he refuse to send. Will such letter keep me
from landing? or remaining here. I am married and have another son
with my husband. what can I do without costly cost.If I was to try to
get legal custody, will my ex be summons.I am scare he might be
spikeful andtell them he never agreed with me leaving with our
son.Since I left he always knew where we were.

There is nothing you can do short of father's consent of court order. It is
your burden to prove that you have the legal right to take child out of
jurisdiction and away from the other parent.

Hi:

Since your child's father refuses to provide written consent, you will have
to obtain a Court Order explicitly indicating that you have custody of your
child.  The Order should also specifically state that the Court will allow
you to take your son out of the jurisdiction.  Since your son has been with
you since birth, you should have no problems obtaining the Court Order.  You
should see a Family Lawyer.  Once you obtain the Court Order, you should
have no problems with CIC.

UN CHARTER on KIDS says ' the child must be with the mom'

so there you go...get a good family lawyer to secure custody in canadian
court...if you're ex-husband IGNORE or CONTEST it he'll have a hard time
convincing Canadian judge why the child should live with him..when in fact
he already abandoned the child in the first place

oh... he's IN for a rough ride...
