HELP CONFUSED!

Hi can anyone help me please? I am in the USA now on a K3 visa for two
years..we have sent in dozens of forms it seems and now have another
lot to do within a year.. they seem to be repeats of the last lots
biography and police clearances etc.. can anyone tell me if these do
have to be done again,,surely they have records of the ones we sent in
for the K3 visa?  and if they do have to be redone can I do it from
the USA? I was under the impretion one could just apply for  extention
of stay until the green card came through

Hi Annya,

Eventually, when your I-130 is approved (which it should be by now,
after 2 years!!) then you will fill out the I-485 and supporting
documents (G-325A, I-864, etc).  That will be your Adjustment of Status
paperwork.  Curious to know what dozens of forms you've been sending in
within these 2 years?  You will have to do another G-325A Biographical
Information, yes.  But you won't need another police certificate.  I
don't think there is such a thing as "extension of stay" - you have to
apply for adjustment of status from the USA, or else go back to your
home country when the time comes for an interview there.  Maybe what
you're currently seeing that you have to do within a year, is the
paperwork from NVC?  Please clarify which paperwork you're talking about
so we can guide you better.

A lot of the paperwork does seem repetative, for sure!!

Thank you for the reply.. I am in the USA on a K3 spouse visa came
here in April this year..
oh I thought it was a mistake  and that somehow they didnt know I was
here as many of the forms are repetitive..
We had to mail a further $365 a few weeeks ago and now we have forms
from  NVC with a big barcode page and a list of documents to send
most are repeats  biography..husbands afidavit of suppoort etc.. and a
list of vacinations which I had in London to get here in April

It would appear that you have decided to do your adjustment of status
outside of the US rather than inside of the US.  Since you mailed money
to the NVC, it appears that you paid the visa fee for the US Consulate
and/or the processing fee for the I-864 Affidavit of Support.  I do hope
that is what you were wanting to do.

And yes, since you are going back to your country for the final
processing of the I-130 then you will have to get a new police
certificate, new medical, and duplicate all of the documents you did for
the K-3.  Why?  Because all that paperwork is now in the US and will not
be transferred to the US Consulate in London.  Also the medical and
police reports have expired and must be redone.

You will not have to renew your K-3 since you only came to the US on
it in April, 2004, it is good until April, 2006.  This means that you
have to finalize/adjust status at the US Consulate in London before
that time.

Looks like you get a trip to London in a few months :)
The main benefit to you will be that you become a Permanent Resident
upon your return, rather than waiting who knows how long to complete AOS
in the States.
