Getting name changed...SSN, DMV, etc...

Hello...

NC DMV says that my wife has to change her name with SS before they'll
update their records, SS says that she has to update it with INS first.

I can't find anything on the USCIS site about changing your name...

I assume we'll have to make an infopass appointment, but what form will
she need to fill out?

Hmm, well I have had clients who have tried this, and CIS says "you can
change your name when you naturalize."  Of course, now that my district
has stopped judicial naturalizations, that's not an option.

The form to replace or correct an alien registration card is Form I-90.
 But this probably won't work unless the name on the alien registration
card is wrong.  The ARC name is taken from Form I-181, which is filled
out based on the I-485.  So if you filled out your wife's name before
marriage on Part 1 of the I-485, that's generally how it will transfer
to the I-181 and then to the ARC.

Confused----what name is she using on which document?  Where are you in
the process?  There is certainly no law that says that a wife must
change her name when she marries.  I'm assuming that your problem lies
in inconsistency of names on documents.  Have you filed for AOS yet?

Haven't filed for AOS yet (just got certified copy of marriage
certificate yesterday). She WANTS to change her name....

And it doesn't seem to be inconsistency of names -- everyone says
"yeah, I understand what you want to do but we can't do that until
someone else does it first". The world is being kept safe from my
wife...

Does the marriage certificate have her named as her maiden name, or did
you choose to change her name then and it has her married name? If its
the latter, just apply for AOS in the married name, and USCIS should
update it, right? If the marriage certificate has her maiden name, then
cant you just change her name with Vital Statistics, and then apply for
AOS in her new name?

All we did was put on our marriage license that I would be changing my
name, so the marriage certificate had my name after marriage with the
new name - I applied for AOS under that name, and once that was granted,
was able to switch over all my other stuff. If youre looking to switch
everything over right now, you might have trouble - all my ID was in my
old name until I was approved for AOS, but all that meant is that if I
wanted to do anything with the new name, I just had to bring my marriage
certificate... a pain, yes - but not the end of the world

After I got my marriage certificate (which, by the way, has my maiden
name on it), I simply went to SSA with my passport, I-20 and SSN in my
maiden name, showed them the marriage certificate and the passport, and
changed my last name to my husband's on SSN card. No problem.

About a year later I applied for AOS in my married name. Never changed
my driver's license or credit cards or name on my old bank accounts.
Just opened a joint bank acct and a credit card with my husband in my
new last name.

I have my maiden name on my marriage certificate because when I told
them I was going to change my name they told me I would have to do
that through SS. Since I hadn't applied for my SS by that point I
simply went over there and told them that while I was applying for my
SS# that I would also like my name changed at the same time. They did
that no problem.

My only problem right now is that I filed for AOS and EAD in my maiden
name, because I sent that off before I received my SS because I wasn't
in the SAVE system by that point. I have since then written them a
letter to tell them that my name has changed since then, but I haven't
really heard anything back. However, I have also since then applied for
an AP, then a renewal EAD, and now also another AP with my new name on
it, and they the letters they sent me back always had my new name on it.
I don't know if my AOS is still in my old name or my new name, but I'm
sure I can get it sorted out when the interview comes.

I don't know why the SS is telling you that you need to let the USCIS
know first. The USCIS shouldn't have anything to do with the name
change! Maybe you should try going back to SS and ask them to change it
again. Maybe you just talked to someone who was new and clueless?
