Hi:
You hit a pet peeve of mine -- 245(i) has been unfairly tagged as an
"amnesty" -- it was no such thing. It was enacted as simply a
procedural change for budgetary reasons back in 1994.
Before September 1994, you became eligible for a visa, but were
ineligable for adjustment -- you simply went abroad and consular
processed. In fact, it was often easier and quicker than adjustment
to do that.
However, in 1996, the 3/10 year bars were added to the law. So 245(i)
took on a substantive meaning.
There is debate going on now that the current law has the effect of
creating an underground class which is not a good thing. Thee is a
possiblity that 212(a)(9) might be modified in someway so that
"illegals" have to leave in order to get a green card. If they are
denied, then the government has no need to deport them.
