For Sunsona and the removal of conditions

I noted today that you are all over this board tacking your questions
onto old posts and posts that really have no relevance to your
situation.

So in the interest of unjumbling your obvious confusion, I will try to
take a layman's stab at straightening things out for you.

You have never put your entire situation down in one thread started by
you but I have gleamed the following information about you from your
many tack-ons:

You were married to a USC.  You obtain residency based on that marriage
and your residency was conditional on the fact that you remained married
for the next two years so that conditions can be successfully removed,
or if you divorced you could file a waiver for removal of conditions
based on a good faith marriage and/or hardship waiver and/or abuse of a
spouse.  You received the initial notice of action giving you paper
proof of the extension of your residency.  Six months ago the Vermont
Service Center notified you that they were sending your I-751 to the New
York City district office as you needed to be interviewed for the
removal of conditions.  As of this date, six months later, you have not
received notification of an appointment for the interview.  Also you
have written to NYC DO asking for a status update.  As well, your one
year paper extension is going to expire shortly.

Firstly, the interview is normal for a situation such as yours.  It is
unusual that the service center will grant removal without interviewing
the beneficiary.  As for the appointment date for the interview, you
must be aware that your situation is not a priority one as your status
remains intact until a decision has been made on your petition.  All you
need to do is go to the USCIS website and make an Infopass appointment
to go to the district office to get an I-551 stamp in your passport
which will be further paper proof of your residency status.

As for the date for the interview, I have seen people, i.e. the website
owners of Kamya, who have waited nearly two years for such an
appointment and they were divorced but were then and now viably and
happily married.

So please put your anxieties aside for a bit.  Writing NYC will do
nothing for you.  However, going in person to get the stamp will jog
their memories that you have a case pending in their office.  Also that
can be accomplished by the intervention of your immigration attorney, if
you have one, and/or the status check made by the immigration liasion of
your local political representative.

Good luck.

im trying to get an appointment through info pass.. but which one
should i pick?

                  Please select type of appointment.
                    You need an immigration form.

You need to replace your Alien Resident Card.

You need to file an application for yourself or someone else.

You have a question about your case.

You have received an approval letter or Form I-797C from the Service
Center or local office instructing you to come into the office for
alien identification card processing / passport stamp.

You wish to speak to an immigration officer.

It has been more than 90 days since you filed an I-765 and you did not
receive an Employment Authorization Card.

That is typical as they only make appointments for two or three weeks in
advance.  Continue to try, preferrably early in the morning or late in
the night.  Those are the times when the release new days and times for
appointments and when they re-release appointments that others have
cancelled.

But what if I pick something else just to get an appointment? I don't
know how they do it now in NY.. it used to be sooooooooo easy, they
check ur idea, and go do whatever.....I have a lawyer, he never told
anything about re-newing or getting the stamp for this time i mean, but
he did tell me last time, cause I was traveling. He just told me to wait
for my interveiw, and most of the time, they'll send me the GC, but Im
not sure about my case, cause I was divorced... Do i have to call my
lawyer to tell him about my stamp that needs renwal? or just go?  I know
u wana kill me from all the questions that im asking.. but im not that
good with this kinda stuff,  ur advice helps me a lotttttttt..

Thank you

Just curious, did you get your appointment in the right category - wish
to speak with officer?

My understanding is that sometimes they have different departments for
each category, and if you make an appointment in another category and go
to it, they won't be able to help you.

Also, if you are still using the services of that lawyer, I would
definitely let him know the status of your case!

Best Wishes,
Rene

Yes, I got an appointment under (wish to speak with an officer)  Thats
why i was asking.. that I need to re-new my stamp on my passport, and if
thats the right catagory for me?

My lawyer already know, and i called him the other day to ask about my
status, he just told me to relax, and everything is going okay.. and
sometimes it takes up to 20 years.. I ALMOST DROPPED DEAD.... Thats why
im sooo nerves about this...

It says in the Infopass ticket.. Appointment Type: infromation
question... there is nothing there about re-newing my stamp... Im taking
a day off from work.. i don't wana go and waste my time, and  they won't
do anything for me..

Great news.  And yes, please advise your attorney of what you have done
so that his records are up-to-date on your processing.

When you go be sure to bring your passport, your EAD, your notice of
action from Vermont and any other photo identification you have.  Better
to be forearmed then to go with incomplete documentation.
