K1 visa denied

Hello group, my question is that if your fiance/fiancee is being
denied of a k1 visa after a consulate interview, can the us
fiance/fiancee file a new petition such as I130?
your answer is greatly appreciated.

Any details like, why? which consulate? you care to share..

My fiancee had been denied of k1 visa, because she and I have a 20
years age differences. We have the interview through the consulate
in vietnam. We really love and care for each other, we want to live
together, how can we do that can I file a new petition such as the
I130, but I'm not sure I'm can do it or not?. I hope my question
could be answer through this group.

Since when is a 20 year age difference a valid reason to be denied?

Are you a USC or an LPR?

Go to vietnam and marry her, you can then file the I-130 as an IR

Depending on how long they are married at the time she enters the USA,
it might be a CR.

But I agree that the age alone shouldn't be the whole reason for denial.
I suppose the ConOff had some other suspicions that perhaps the
relationship wasn't real, and thus denied it.

To Sh - are you SURE it was totally denied?  They did not ask for more
evidence of the relationship or more paperwork?  What exactly did your
fiancee receive from the embassy?

Sh,

The visa was more likely denied because the consular officer did not
believe that the relationship was bona fide - had reason to believe that
the woman is more interested in getting into the USA than she is
interested in you.  The age difference may have been a factor, but it is
undoubtedly not the only factor.

Whether the marriage is proposed (fiancee) or accomplished (spouse), the
woman is going to have to overcome that belief.  Simply getting married
is not the solution.

How can it be that your fiancee has been denied the visa? You just
posted on the 20th of September that you were preparing the petition.

That would be a new world record for turnaround, so I'm just curious.

While I must point out that you have to be married to the person in
order to file an I-130 for them (and that may or may not be viable
depending on your situation)... yes, you can file an application for a
different visa. There's no guarantee of success though, and for whatever
reason the original K-1 was denied may be the same reason that an I-130
is denied. So, I guess the question becomes: would you rather have a
fiance who is not admissible to the US, or a spouse who is not
admissible?
