I-130 hell

Hi, i need some info and seeing as govenment agencies dont want to give
you any information, i am hoping that an expat might know something...

I got married last may to an american citizen and we have been living in
my house in the UK ever since.

We applied for an I-130 at the beginning of the year at the us embassy
in london. They then sent our request to texas, and then on to
california.

I have been watching the processing dates online and saw that they
finally got to my application 2 weeks ago. BUT when i call and automated
number to give me the status of my visa, it says that there is a 990 -
999 day process time for visas!

Is this true? will it take us another 3 years to move to the US?
Can someone that knows please help me with this cos im going crazy
(especially as i have just sold my house and am moving into rented
accom. anticipating a 3 month wait for my visa!)

The automated response you heard is just a standard response.  Pay no
attention to it.  It'll keep saying that until your petition is
approved.  The message *should* change when you are approved.

Hi:

Yes, it is true that the info system gives an estimated processing time
of 999 days.  However, I wonder how you get that it will take three
years for you to move to the US.  You don't give any basis for that
statement.

On the processing times -- please note that the processing times
published on the net reflect ONLY a statement of the oldest case "on the
shelf" awaiting processing for adjudication.  So the fact your date has
been reached means ONLY that the petition was sent to the "floor" for
processing -- and processing doesn't necessarily mean approval.

hi,

i say three years because 999 days is pretty much 3 years.... as for the
petition being sent to the floor, yeah i read that quote on a
website..... my question through all of this is really just this... when
i call the info line and it says that they have my i 130 and it is being
processed and that the current waiting time for this is 990 -999 days,
should i believe that or is it shorter and they just say that to give
themselves some time just incase it takes longer?

First, don't call the 1-800 misinformation line.  An utter act in
futility.

Second, take 999 days as the timeline and anything less than that will
be a wonderful surprise.

Third, get the information required for the K-3 visa which might be much
less time than that quoted for the I-130.

Hi:

Give it the same credit you give to any other piece of fiction.

BTW, CIS has publically expressed its intention to purge those
statements from I-797 and the mis-information line.  Furthermore, it
pays to remember that the purported processing time included ALL I-
130's, not just Immediate Relative Spouses.
