Hi, I'm new here, and have tracked this site down from VisaJourney, and
wondered if any of you guys and gals can offer any advice.
Its a bit long winded...but has me somewhat worried, though it might be
un-necessary, I hope!
A couple weeks ago I applied for my UK police check with West
Midlands Police.
I have a couple of queries if anyone can help, I've searched the forum
for the past hour or so looking for similar instances...
1, I have a conviction at a Magistrates Court for speeding, as I was
going a wee bit fast, so chose to attend court. This tallied up to 11
points on my licence in 1998.
Then in 2001, I was the innocent party when another individual drove
into me, we swapped details and agreed everything was fine, then months
later receive note that the other party was taking me to the county
court for damages. I chose not to attend - as I was confident....then I
was instructed to pay a about £2000, of which I paid some, then 'moved
house'.! SO didnt pay anymore and heard nothing more - although I was
blacklisted for being in debt.
I was a good lad for while then in 2003 was found guilty of driving with
faulty light and no tax/mot. I sent my plea of guilty in to the courts
and receied a subsequent band of 6 months.
My question is will any of theses appear on my police record check? If
so what will I have to do, if anything?
2, When applying for the subject access form, I noted my address as with
my parents - which has been my registered address for 20+ years,
although, they informed the courts (due to debt) once I'd left home.
Which I did for a while earlierthis year. I have never registered
another address.
The reason I ask this question is I contacted the tax office a week or
so ago about an old cheque that I wanted to cash, but they told me I
was no longer on the electoral roll at this address anymore. Although
I've now informed the tax office that this is still my address until my
visa arrives.
Will this affect embassy /police checks do you think?

Hmmm, interesting list there.
I'm not 100% or an expert BUT to me driving convictions and a crash
shouldn't effect whether your allowed to apply to stay in the US.
Anyone can be in a crash, be it your fault ot not but it doesn't really
put you in a risk category accept for car insurance.
However the missing court and not paying the damages be it if you were
guilty or not.............that sticks out. Maybe if you told the court
you would not attend due to the agreement rather than (what appears to
me) just not showing up then you'd be in a better position.
But all this is just my opinion and not gospel. I'm sure others will be
able to help you out.

The missing payment so to speak was in a civil county court and
according the criminal records beareau will not appear on my subect
access cert.

Have you actually recieved your Police Report yet ? It all depends what
is on that report the rest is Irreverent.
Personally I think your be fine but if three crimes are on your record
and their seems to be a pattern then the embassy might get a bit
twitchy. I’m really surprised the court hasn’t chased you on paying
your fines… They did me ….

I had an offence of driving without a licence and insurance ... Went to
Magistrates and was given a 6 point endorsement and fine.
Speaking to the local Police Station about this offence they said it
would show on my record...
Three weeks later when I recieved my record ....... NOTHING , Clean.....
However, I still declared it to the embassy just incase as I know they
work closely with scotland yard.

Thanks for the reply, as it was a civil matter , they followed it up,
then nothing came of it. I was going thru a 'tough' time and for one
reason or another, chose not to pay it. As i said, hopefully being a
'non' criminal offence I'll be fine.
With re to your offence, similar to mine at the Miagistrates court,
thanks for that, its very helpful to think that you were in a very
similar position.
Speaking to 'NACRO' and the criminal records beareau, they told me
yesterday that the embassy DOESNT follow up to check if an invidiual is
speaking the truth about a clean ccertificate. 3 individuals told me
that yesterday, which I do find hard to believe. Not that I wouldnt be
forthconming, but its still odd.

It all depends mate. Generally the embassy doesnt check but if there is
a need they can.
I have it on good grounds that the Embassy works very closely with
Scotland Yard and my honest advice is dont chance anything ..... Be
straight up with them, they respect it more.

Cheers mate, have every intention of doing so and wouldnt take
anything to chance. So you dont think I'll need to file an I601 in
this instance?

from what your saying doubt it... Check the official regulations on the
USCIS website.
