Timeline - K-1 through to RoC

Hi everyone,

I haven't posted much in the last few months, but I thought
there might be some interest in a near-completed timeline (as
complete as it's going to get for a while, because it's going
to be a long time before I meet the citizenship
requirements!).  I've pulled up all the timeline information I
have and am posting it together here in case it's of use to
anyone.

This is for a British citizen (that'll be me, then) on a K-1.  
I've split it up into three sections to try and make it
clearer for anyone who might be after a particular bit of
info.  I've no idea whether some of this procedure is now out
of date, as I no longer keep track of changes to the earlier
part of the process.

Part 1 - K-1 application
~~~~~~~~~~~~~~~~~~~~~~~~
* July 11, 2002: Received second NoA through TSC
* July 18, 2002: Posted all documents in one go (Bio data plus
IV15 and other stuff)
* August 7, 2002: Received appointment letter for interview at
London Embassy
* September 9, 2002: Appointment at London Embassy, K-1 issued
* October 2, 2002: Flight out to Austin via Atlanta on K-1
* December 15, 2002: Targaff and Sioneva get hitched in
Seattle

Part 2 - AoS application
~~~~~~~~~~~~~~~~~~~~~~~~
* March 22, 2003: I485/EAD application sent (confirmed
received 24/3)
* April 19, 2003: Confirmation letter (dated 19/4) received,
incl. EAD
appointment date
* May 1, 2003: EAD appointment at San Antonio BCIS office
* May 30, 2003: AOS appointment letter received
* June 17, 2003: AOS appointment at San Antonio BCIS office
* July 7, 2003: 2-year I-551 card received

[There's a bit of a break here, but there's some stuff that
may be relevant.  We left the US on 18 August 2002, as I had
been offered a place on a postgraduate course back in the UK.  
We submitted an AR-11 to change address; no acknowledgement
was received, but documentation has been sent to the right
place since.  I forgot to file for a re-entry permit because
we had trouble getting Sioneva a UK visa and it got put to one
side as a result.  I came back to the US for a visit on 10
February 2004 and submitted an I-131 at that point, which was
acknowledged soon after and then received about 5 months
later, valid until the expiry of my I-551.  Which brings us
to...]

Part 3 - Removal of Conditions

* June 8, 2005: Submitted I-751 application and I-131 for new
re-entry permit, both to Nebraska Service Center (confirmed
received 9/6 and 16/6 respectively)
* September 22, 2005: Received confirmation that application
approved, directions to obtain new I-551 from Seattle office
(new re-entry permit was received around this time, too)
* December 22, 2005: Actually find out that application was
approved - boy is it a good idea to actually have these
letters opened!

The letter actually says not to travel outside the US until
you have confirmation that the replacement I-551 is being
processed, but since I was outside the country already I can't
really do much about that.  I'm back in the US in January, and
while I don't envisage any problems, I'll post in case this
does cause issues.

So there you go.  I hope someone finds this useful, and my
thanks once again for the advice of the regulars here.

1. When you came back for a visit did you use your GC or VWP?

2. How have you maintained permanent residency in the US?

Well I did only post it yesterday :)  Though I myself am surprised no-
one's commented on the quick turnaround for the removal of conditions: at
the time it was submitted I-751s at NSC were reported to be taking around
a year.

I used the GC.  Actually when I originally flew out on the K-1, I was
told at the airport that the VWP couldn't be used if you had a valid visa
or residency.  Whether or not that is the case I don't know, but there's
no real benefit gained from not using the GC.  The only issue it ever
presented was that I did put "UK/US" down as my place of residence on one
of the forms I filled in at the time (which was technically true), and
the immigration officer said that presented a potential issue for him
because by stating that I was resident in the UK I was saying I wasn't a
US resident.  He did let me through, though.

A re-entry permit and semi-regular visits (< every 6 months).  We also
detailed in the I-751 cover letter the circumstances surrounding why we
hadn't been in the US much.  We were curious ourselves as to whether or
not our application would "fly" - if it had been refused we wouldn't
really have been surprised - but the choice between making an application
and not doing wasn't really a choice.

I think your OP has a typo in it on the date you left for London -- I
assume it was in 2003, not 2002.

That would make a bit more sense.

Am I right in thinking that the issuance of a I 751 is a bit like the
issuance of an AP, it does not come with any acknowledgement of its
validity at the POE.

Hi:

The Re-entry Permit, Refugee Travel Document and the Advance Parole are
all applied for via the I-131.  The advance parole cannot be used unless
it is GRANTED prior to departure foreign.  In contrast, the application
for a Reentry permit need only be FILED prior to departure foreign.

In direct answer to your question -- there is NEVER a guarantee of
readmission.  Just that once you have been granted LPR [including CPR],
asylum status or US citizenship, the port of entry is not allowed to
follow summary removal procedures if the person claims the benefit of
such status AND the computer system verifies that the person EVER had
such status.  If the POE is unable to verify the existence of such
status ever having been granted, the person is read the Riot Act and if
they insist, an order of summary removal is entered but the person is
referred to Immigration Court for the limited purpose of examining the
asylum/lpr/citizenship claim with the person being detained in the
meanwhile.

Sorry, yes, you're correct.  Less a typo than me not paying attention to
what I was writing, though, I suspect.
