I'd Really Appreciate Your Answers

My marriage based AOS interview was at Charlotte,NC on Dec 21st 2005.Our
appointment was at 1.15pm and we were seated at 12.35pm.

My name was called after about an hour and we followed the lady officer
to her office.She asked us to remain standing raise our right hands and
swear to tell the truth,we did.She offered us seats and got down to
business.She was very nice,straight forward,serious and really
officious.

She asked first for our drivers licences,matched our addresses and gave
it back to us.She then went on straight to ask me if i have left the
country since i came in?If my birthdate was correct?the questions on the
485 form all to which i answered NO.

She asked me for my SS card wrote something down and handed it back to
me.Next she asked if we worked I answered yes and handed over my
employer's letter and paystubs,she looked at them and asked for my
hubby's,we told her he was self employed and worked for himself,she said
I need proof so we gave her the 2004 tax returns.She did not like that
we checked 'married filing separately,she kept asking why why why...we
told her I had not got a job then so there was no way I could file any
taxes at all.She said 'ok,i am going to ask you(that is myself)to fill
out I-864A,cos I want to consider your income as well'(my salary is
quite good,so I am guessing that may have been why,dunno for sure).I
filled it out and handed it over to her.

She said 'ok,do u have any other documents to show me today?'I gave her
my originals and she asked if i had copies,i said yes and handed them
over to her.She took them and started to look one after the other,as she
was looking she asked how we met,we told her and said she said 'i assume
that is when u began dating',my hubby and I looked at each other n began
laughing kind of trying to picture again our courtship she caught that
and smiled too.

She began to punch the copies and put them in my file i didnt realise
until then I had so much docummens with me and it seemed not to end as
she kept filing them and i thought my file would not be able to close,as
she did this,she talked to us about her home state and other stuff,she
was a real nice lady,i must say.Then she said 'okay..I need the
telephone number of your landlady'(it was not on the lease,we subletted
our apartment from an individual not a company)she said they just gave
them a notice indicating they shd make sure there is telephone number on
the lease,that other couples compalined too that no one told them and
she said well it is brand new notice to the officers and she apologises
but she has to follow procedure.

She said everything else was okay and she only needed that but we
couldn't remember the number so she gave me an envelope and said 'write
in there your landlady's name,address n telephone number and send it
back to me.The sooner i get it the sooner you will get your receipt but
le tme go ahead and print it so you can see what it will look like(she
went and printed me my receipt) and said"this is what you will get in
the mail when i receive the envelope back.I will explain to you what is
written here.And once you get this from me,your green card will come
three weeks after that.This will be the date on your green card which is
today's date regardless of when i receive the envelope i sent to
you,this will be the date on your card.You are to file form I-751
between September 22 2007 and December 22 2007,failure to do this will
result in deportation proceedings.'

Then she went on to say,"Now let me tell you more about your card,have
you heard anything about conditional green card before?' i said,yeah i
read about it on the internet,she said 'ok,let me explain'.and she went
on to explain what we already know about less than 2 yr marriage etc
etc.She gave me a lot of tips what documents to send in during that
period and how the process is done and why some couples are called for
interview and others are not at that time.She asked me if i had any
relatives in the US.Then she said that will be all.we thanked and her
and she wished us happy holidays.

I came out with mixed feelings.Please guys let me know what you really
think.Cos i am kinda wondering.I do not know what to think.

Why didn't she ask for my passport and EAD,even just to look at them?

If I wasn't approved,would she have told me on the spot or how does it
go when people are not approved?

Two things she said keep ringing in my head'I cannot make a decision
today' 'Your green card will have today's date on it regardless of when
i receive the envelope i gave to you'One statement sounds like no
approval and the other sounds like approval.

Ummm i suggest you start celebrating, sounds as if you are definitely
approved. You just need to get that paperwork into them asap. She didnt
take your EAD as you still have paperwork which u need to send in. I
think you should be pretty happy, sounds like good news :)

I pray,I am really praying...you know with this process it is not over
until it is over and you just never know,I keep looking out for the
postman...

Have you sent out the paperwork the officer asked you to? I would
suggest that if you don't receive it in the 3 weeks she told you,
that you make an infopass appointment. Have you checked your receipt
number online? If not maybe its worth a try :

That should update when its been approved, but sometimes it can be
slow, so if its not updated don't worry. I just sugest that you try
to be patient and wait it out, sounds as if u were approved as long
as you gave them that info. I know its hard and you want to be sure,

are u kidding me?lol...I sent it out as soon as I got back home..i
hadn't even takenoff my clothes when i checked my phone caller IDlist
for my landlady's phone number then called her and got her whole
info,physical address etc..i wrote it,put it in the envelope and drove
straight to the post office(this was at 8.30pm!!).It takes a day for
mails to arrive Charlotte from where I live..so I knwo she got it the
next day.I have been checking my receipt number online too every
time...I plan to get infopass if I don't get anything in two weeks
from now..

LOL i wouldnt worry too much as it sounds like you really have been
approved, but stuff can get slow and mixed up so i understand your
apprehension. I wish you the best, if nothing else it sounds like your
interview went pretty smoothly :)

Sounds, like nothing to worry about.  Guess they want the Landlord proof
you are living together.
I would say don't worry, though it is hard to not worry, when dealing
with USCIS.  Even when you are perfectly legal & above board, still
stressful.

Hi,

I have a question. What kind of tips did the USCIS adjucator give you
regarding the I-751. You mentioned in your post that she told you why
some couples get called in for interviews for their I-751 & some do not.
What were the reasons. You also mentioned that she told you how the
process is done, what did she tell you about that? I was just wondering
because my husband & I just filed our I-751 jointly to the CSC on
8/17/05. I would really appreciate your response & thanks in advance.

then she said removal of conditions doesn't really require interviews,so
it is a more harder process(I wondered how)..but she said it is because
couples are not required to come in for interview,just to send in as
many documents as they can.And it is harder because couples won't be
there to defend any questions the reviewing officer may have.Any
whenever they have any question whatsoever they send it to them(that is
those who interview us)to call them in for interview.She said stuff like
buying a house together,having children together,other 'serious'legal
steps couples take,would make them remover condtions in a heart beat,but
when certain things they feel married couples ought to have are not
there,they do not waste time,they send for those couples...and other
things like that...i hope this helps..i didn't pay too much attention
cos i was like...i am not facing that music now..

Thank you so much for your response. Good luck to you & happy holidays
to you & yours. I just know things will work out for you. According to
what you wrote in the post your AOS interview seemed to go real well. If
you don not mind I will say a prayer for you. Let me know what happens.

I recall discussing issues like this with a senior adjudicating officer
at the CSC as I was taking one of my many tours of that facility. We
had this discussion as we were standing in/visiting the unit that
processes I-751s.

If the officer suspects a marriage of convenience (one friend helping
another friend obtain permanent resident status) they will forward the
I-751 to the local office for interview. And for quality control
purposes, they also select around  5 to 10% of the I-751s (no matter how
well they are documented) and send them to the local offices for
interview. Finally she mentioned that if someone engages in wild
overkill with their evidence…. Well that is going to be the thickest
file in the box and she mentioned that sometimes an officer might be
tempted to select that particular file to forward to the local office
for interview. Let “them” deal with it.

I always try to put together a well-documented submission while at the
same time not engaging in overkill. It’s a judgment call in each and
every case.

Udall,
Your input is well appreciated and understood.Bottomline is just be
moderate and top it all be prayerful since this whole process depends on
the 'individual' adjudicating...n being practically at their mercy...

you didn't answer me however how long it takes for situations like mine
where info is requested to be sent in at the interview...

I can't answer this, as every case is different. This is not like
mathematics of physics where one can expect consistent results time
after time.

lol..that was funny..in spite of my self and situation I laughed out
real loud..I guess I'd just have to wait..who knows,may not be for
long..My landlady didn't call me yet to let me know if the officer
called her or not,cos I am assuming she would give her her a call since
she asked for her telephone number...

Not necessarily.  The Officer just might have wanted complete
information just for your file.  It doesn't mean she'll call the
landlady.

Mr Udall,
How do they suspect if marriage is marriage of convinience? Sometimes
genuine couples dont have enough property or evidence for various
reasons.
So what would trigger their suspicion? And what questions do they
usually ask?

It sounds like youre 99% done with this stage then! If in a couple weeks
you havent had the letter, make an infopass appointment.. I can see no
reason to print off the letter if she wasnt going to send it you!

Oh, and don’t put too much stock into her wild guess about the card
arriving in 3 weeks. They don’t manufacture the cards at the local
offices (I’ve seen the machines at the "service centers" they use to
manufacture the cards… a clean room environment and a fascinating
process) and anything she said was a wild guess. But with that said, it
does seem that the cards are arriving pretty quickly now (which has not
always been the case in the past).
