130 approved after long security clearance

It's been ages since I've posted as there was no news to report. Quick
refresher, my husband's last name is Atta which is not one you want to
have in today's world. But for anyone asking the question "how long does
an IBIS hit take to clear?" our answer is 2.5-3 years.... but by God,
we've cleared it. I received my official approval letter yesterday that
we are being transferred to the NVC.

So here's our summary
I130 filed NSC - May 14, 2002
File sent to Washington DC for Security Checks - October 2002
K3 Filed - October 20, 2003 (it's still pending a security clearance in
DC)
2003 - waiting on security clearance
2004 - waiting on security clearance
February 2005 - Hired new attorney, drafted initial letter threatening
mandamus
April 2005 - File suddenly became active again
October 2005 - File transferred to KC, Marriage interview (RFE for not
having the marriage certificate with the date showing the state received
it. Husband has that one, I have the duplicate given to us the day we
were married).
Two days after interview - Copy of marriage certificate delivered to KC
district office.
January 4, 2006  - Approval letter received in the mail saying it's
being forwarded to NVC

I hope the remaining hurdles aren't quite as big as this one was...and
that future security clearances won't take this long.  We're just
thrilled the wheels are in motion again.

Hi Tonya:

Actually I don't think he is guilty of being Atta but more being guilty
of being Arab.  But lets not talk about my case where US based DHS is
being driven by their overseas offices in China to kiss the a.s of the
Chinese government and my client is a pawn in the middle -- again, don't
get me started --

I believe I"ve utterred that phrase a million times over the past four
years. Everytime someone would ask me how things were going, how the
letter writing was going, how the inquiries from my Senators and
Representatives were going... And every time I'd talk to the one Senator
that was able to tell me, on repeated occassions, that the case was
still in Washington DC for "a perceived threat to national security and
would remain there indefinitely". Knowing that following 9/11 and a six
week investigation by the FBI (that we fully cooperated with) and were
questioned, polygraphed, followed, searched and ultimately declared not
to have had anything to do with the attacks or terrorism.... Yeah...
don't get me started either. :)

Testimony elicited by the GOVERNMENT about the legal system the UNITED
STATES government wants to sent my client back to:  The police
investigate pursuant to their law and procedures, refer to prosecutor
for review who then refers to judge for sentencing.  I kid you not.  The
only thing I can say is that at least there is no police testilying in
this case.

BTW, I just watched the DVD of 1966's "Best Picture" "A Man For All
Seasons."  Sir Thomas is respected, revered and remembered for his
principled stand -- but he DID lose his head.
