Re: the residence issue, a name on a deed does not in and of itself
constitute proof of residence. If that's all you sent in, that's
possibly why you got RFE'd for that. I'd suggest sending copies of any
recent bills in both you and your spouse's names that are addressed to
your residence (not a P.O. box, if you use one) and maybe copies of
other items addressed to you both at the same address. We sent in a
couple months copies of several items in both our names and addy, such
bills (phone, util, credit card), church bulletins, bank statements,
insurance statements, and so forth.
Some of the above might also help with evidence of good faith marriage.
Did you send any recent pics of you and your wife together? If not,
send some. If yes, maybe send more? One thing we made sure to include
were copies of the above spanning several years, to show we were still
married and living together since our AOS interview.

We never bothered changing the utilities to joint names and even the
credit card bills for the joint card are only addressed to one of us.

Thanks, it did help, I'm just going to resend everything I can find
plus a few new things like medical insurance letters showing me as
spouse on Cathy's insurance.

Hi Denis:
Wouldn't worry too much as this could be good news.
I filed my I-751 in July 2005 with the Texas Service Center (live in
Florida), and received a letter informing me my file was being sent to
district office for interview. Didn't worry too much as I had lots of
evidence although most sent with I-751. In December 2005 I received the
same RFE as you asking for exactly the same things. Sent them off
immediately and within 3 weeks received an approval without interview.
Made my infopass appointment and got new stamp in my passport with 10 yr
GC to follow.
Not sure where you filed your I-751 but there was some talk on the
boards of files being transferred to California for interview waivable
cases. Certainly worked for me.
Best of luck

Thanks Belinda,
I did actually file at CSC but, as you point out it is a certain
indication that something is moving somewhere!

Hi Denis
When exactly did you send in your I-751 to the CSC? Did you file a joint
petition with your wife? My husband & I filed our joint I-751 petition
to the CSC on 8/18/05 & we are still waiting for a response. We did
receive the NOA extending his green card on 8/21/05 but since then we
have heard nothing else from the CSC it is now a little over 5 months.
Why did they ask you about your previous marriage? Were you married
before? I don't recall the I-751 form asks for previous marriages.
Appreciate your response.

Hi June,
I filed jointly with Cathy on 6/21/05 so you are about two months
behind me.
The previous marriage part is if you are no longer married to the
petitioning spouse. I am and we filed jointly in June which was why I
was surprised that they even asked about it.

Hi Denis
That is surprising. Why would they even ask that question about a
previous marriage when you did not indicate that on the I-751 petition &
you are filing jointly withyour wife that petitioned you. Were you ever
married before? I petitioned for my husband & like I said we filed
jointly on 8/18/05. The CSC has been working on June 2005 I-751
petitions since July 2005. We have already been waiting now for over 5
months. Good luck to both you & your wife I know things will be just
fine. I know it is a hassle but send in everything you sent them before
with a letter indicating such & also send in any new things that have
both your names & addresses on them including junk mail. Did they send
you a special envelope to send your evidence back to them in? Does the
letter say that you have to send it back to a particular person? Look
forward to hearing back from you.

The letter might simply be a form letter that takes into account
different scenarios, and whatever doesn't apply to your case, you don't
have to provide.

Hi Rene
But even in a form letter wouldn't they check off the items that they
want you to address? That is how Denis made it sound was indicated in
his RFE letter. What do you think?

Hi June,
I was married before but I had to show all the divorce stuff for the
K1 Visa and again for AOS.
I'm getting all the stuff together to send. They did send me a special
envelope to return it in but it isn't going to be big enough! It's not
addressed to a particular person but at the bottom of the address it
says - Attention: RFE
I'll let you know when I hear anything.

Hi Denis,
Thanks for your response. Since the envelope they sent you for the RFE
is not going to be big enough I would imagine your going to send
everything in your own envelope, but does the envelope they sent you
have a particular address on it that you have to send it back to them?
Then I guess you would put Attention: RFE. I am just asking in case I
get one. Denis are you the one who is getting the conditions removed
from your GC or are you the US citizen? I am the US citizen & I was
married before which I showed them proof of my divorce both during the
K1 fiance visa process as well as for the AOS interview. Anyway would
appreciate your response.

Hi June,
It's just the standard CSC address as far as I can see, I'm just going
to use it as an address panel on a larger envelope.
Cathy is the US citizen and I'm the one that was married before.

Hi:
"Inefficiency"??? What inefficiency? They used a "boilerplate" RFE.
It is YOU who is being ineffcient in venting here.
Response to RFE can be one of three varieties:
1. Give them what they want.
2. Given them part of what they want and tell them to adjudicate.
3. Give them nothing but tell them to please adjudicate on what
they have.
The one thing you can't do is ignore the RFE.
Principle: you want them to say "yes" -- so don't fight City Hall. The
only vent I allow myself in responding to these RFE's is a comment: "As
per your request, enclosed please find an additional copy of the
documentation originally submitted."

Good avvice, as ever.
I certainly never intended ignoring the RFE and I've gotten together
some new stuff I didn't send before so I'm just goiing to be a good
boy and send it all in.
Denis
I guess the thing that needled me was the inference that I was not
still with Cathy when she in fact signed the form!
