Visa Waiver - how often and for how long?15 Mar 2007 17:41 GMT44
I have read some of the posts on this forum saying that a general rule
when using the Visa Waiver is that you should wait 3 months before going
back to the U.S. on it again.
Is this always the case?

I am currently in an odd situation. I am presently holding a valid H1B
work permit and working in US. During my last entry to US, the
immigration officer at the NY Port of Entry stamped my I-94 to be
valid until May 06, 2007 seeing that my passport expires on May 7,

My partner is in the US...I am in Canada. I did go to the US to be with
him and was totally green about the immigration laws and the border
guards knew it. They held me at the border for two hours (I was with my
man), accused me of going to the states to stay etc. It was a horrible

My father filed a I-130 petition for me, and it came back approved, so I
have to wait for the number and stuff...
given my not so good record I wonder, should I even bother to follow through
with this once the time for AOS comes up, or apply for Canada using skilled

I just got touched to inform me that my EAD NOA - approval has
been sent.
Also another touch to say they requested my card but this might take
upto 30 days.

Im currently in India and my h1 b visa expires on June 1. Do i need to
go to the US to renew it ? Is renewal possible while in India, without
travelling to the US ? If you have more details, do let me know.
