This amendment was not passed by a constitutional Congress and ratified
by three fourths of the states as required by the Constitution.
1.  Senators and representatives from the southern states were
unconstitutionally

The citizenship clause in Section 1 of the 14th Amendment reads:
   All persons born or naturalized in the United States, and subject to
   the jurisdiction thereof, are citizens of the United States and of
   the state wherein they reside.
